Il reste \u00e0 la t\u00eate du pays jusqu\u2019en 1990 et s\u2019exile \u00e0 Dakar (S\u00e9n\u00e9gal) suite \u00e0 un coup d\u2019Etat. Hissein Habr\u00e9 est alors accus\u00e9 de crimes contre l\u2019humanit\u00e9, de crimes de guerre et de tortures qu\u2019il aurait commis durant son temps au pouvoir.<\/strong><\/p>\n<p>Les diff\u00e9rentes d\u00e9marches judiciaires sur le plan national, continental et international entam\u00e9es par les associations de victimes, les soci\u00e9t\u00e9s civiles, les ONG locales et internationales ont conduit \u00e0 une entente de principe entre l\u2019Union africaine et le S\u00e9n\u00e9gal sur la mise en place des chambres africaines extraordinaires (CAE). Greff\u00e9es au syst\u00e8me judiciaire s\u00e9n\u00e9galais, les CAE ont pour objectif principal de juger Hissein Habr\u00e9. Le proc\u00e8s a d\u00e9but\u00e9 le 20 juillet 2015 \u00e0 Dakar (S\u00e9n\u00e9gal).<\/p>\n<p>Thinking Africa porte un int\u00e9r\u00eat au cas Hissein Habr\u00e9 car le contexte global de la tenue du proc\u00e8s soul\u00e8ve la question de la l\u00e9gitimit\u00e9 pour juger les crimes contre l\u2019humanit\u00e9 commis par les chefs d\u2019Etat africains. En effet, qui est l\u00e9gitime pour les juger? Au niveau international, la Cour p\u00e9nale internationale (CPI) est d\u00e9j\u00e0 discr\u00e9dit\u00e9e dans ce r\u00f4le car elle serait \u00ab\u00a0anti-africaine\u00bb, \u00ab\u00a0imp\u00e9rialiste\u00a0\u00bb et \u00ab\u00a0raciste\u00a0\u00bb.<\/p>\n<p>La grande majorit\u00e9 des cas trait\u00e9s \u00e0 la CPI depuis son entr\u00e9e en vigueur en 2002 sont africains (C\u00f4te d\u2019Ivoire, Soudan, Kenya, RDC entre autres). Au niveau continental, les Chambres africaines extraordinaires (CAE) sont mises en place pour corriger les failles de la CPI mais sa l\u00e9gitimit\u00e9 est aussi remise en cause lorsque la question de son financement est pos\u00e9e. L\u2019Union africaine brandit l\u2019article 16 du trait\u00e9 de Rome et met en avant l\u2019immunit\u00e9 des pr\u00e9sidents en exercice lorsque ceux-ci font l\u2019objet d\u2019une accusation. Enfin, les pays h\u00e9bergeant des chefs d\u2019Etat soup\u00e7onn\u00e9s d\u2019avoir commis des crimes contre l\u2019humanit\u00e9 les extradent ou les arr\u00eatent tr\u00e8s difficilement. Bref, la question reste enti\u00e8re: Qui est l\u00e9gitime pour juger les crimes contre l\u2019humanit\u00e9 commis en Afrique\u00a0?<\/p>\n<p>Dans ce contexte, Thinking Africa, en partenariat avec Trust Africa, a r\u00e9alis\u00e9 des entrevues avec des membres de la soci\u00e9t\u00e9 civile, des \u00e9tudiants en droit et des experts pour apporter un \u00e9clairage sur les diff\u00e9rents aspects du proc\u00e8s Hissein Habr\u00e9 et ses implications pour la justice et la lutte contre l\u2019impunit\u00e9 en Afrique.
