Il \u00e9claire la m\u00e9fiance des Etats \u00e0 ce mode de r\u00e8glement de litige \u00e0 travers la formulation des clauses d\u2019arbitrage, l\u2019initiative de saisine des tribunaux d\u2019arbitrage en cas de litige, les sentences arbitrales majoritairement d\u00e9favorables aux Etats parties au contrat.
